About us

In these terms, "we", "us" and "the studio" mean Dagmara Studios, 8A Minshull St, Knutsford, WA16 6HG. "You" means the person booking the session. Contact us at info@dagmarastudios.com.

Booking a session

A date is held only once a booking fee has been paid and we have confirmed the booking in writing. Until then, enquiries do not reserve anything and the date stays available to others.

The booking fee is 25% of the session price. It comes off your final balance and is non-refundable, because once a date is held we turn other work away for it.

Payment

The balance is due on or before the date of the session unless we have agreed otherwise in writing. Print and album orders are paid in full at the time of ordering. Galleries are delivered once payment has cleared.

Changing or cancelling

If you need to move the date

Give us at least 14 days' notice and we will move your booking once to another available date at no extra cost, subject to availability. Later changes, or a second change, may require a new booking fee.

If you cancel

The booking fee is not refunded. If you cancel within 14 days of the session, the full balance remains payable, as the date can rarely be filled at that notice.

If we have to cancel

In the unlikely event that illness, equipment failure or something outside our control prevents us photographing your session, we will offer the first available alternative date or a full refund of everything you have paid, including the booking fee. Our liability in that situation is limited to the amount you have paid us.

Weather and outdoor sessions

Outdoor sessions go ahead in most British weather. Where conditions would genuinely spoil the photographs or make them unsafe, either of us may move the session to another date at no cost.

On the day

Please arrive on time; sessions run to a booked slot and lateness comes out of your own shooting time. If you are bringing children or animals, bring whatever keeps them happy. Let us know in advance about anything we should know, from access needs to a family member who would rather not be photographed.

Your photographs

Delivery

Your edited gallery is delivered within four weeks of the session, usually sooner. It is hosted on a private, password-protected Pixieset gallery and stays available for 12 months. Please download and back up your images during that time.

Editing

We select and edit the images we consider the strongest, applying colour correction and our usual finishing. Unedited or raw files are not supplied. Retouching beyond our standard finishing can be arranged and may be charged separately.

Copyright and how images may be used

Under the Copyright, Designs and Patents Act 1988, copyright in every photograph stays with Dagmara Studios. Booking a session does not transfer it.

What you receive is a personal-use licence. You may print your photographs, share them with family and friends, and post them on your personal social media. We would appreciate a credit but do not require one.

You may not:

• sell the images, or use them to advertise or promote a business, without a separate commercial licence;
• enter them into competitions or supply them to publications as your own work;
• edit, crop, recolour or apply filters to the finished images before sharing them, as they are published as a piece of our work;
• remove or obscure any credit or watermark where one is applied.

Commercial and brand clients are licensed separately, and the scope, territory and duration of that licence are set out in the quote for the work.

Using your photographs in our portfolio

We would like to show a small selection of your images on this website, in our studio and on social media. We will ask first, and no means no with no effect on your session or your price. If you agree and later change your mind, tell us and we will remove them. See our Privacy Policy for more.

Model releases and other people

If your session includes other adults, please make sure they know images may be shown as above. Children are only photographed with the agreement of a parent or guardian, who must be present throughout.

Prints

Prints and albums are made to order, so they are exempt from the usual 14-day cancellation right under the Consumer Contracts Regulations once production has begun. This does not affect your rights if an item arrives damaged, faulty or not as described — tell us within 14 days of delivery and we will replace it.

If something goes wrong

Talk to us first. Most things are fixable and we would always rather put a problem right than argue about it. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise our total liability is limited to the amount you have paid us for the session concerned.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
